MEMORANDUM -2- March 1 , 1983
The Water Conservation Board has invested over $1 ,000,000 in
the Blue River Project. Construction work has progressed to the
point that we can be assured that about $140,000 of the $1 .2
million authorization will not be used for construction
purposes.
The use of the remaining CWCB funds for a water augmentation
plan is in full conformance with the planned development, as out-
lined in the feasibility study, and would complement the project
that has already been constructed . However, when the Board orig-
inally approved the project, it was not contemplated that CWCB
construction fund moneys would be used to acquire water rights.
Thus, this matter is referred to the Board for its consideration.
Recommendation
The staff recommends that the Board approve the request for
making up to $140,000 available for the purchase of the Vidler
Tunnel Ditch Company or any other comparable water rights subject
to the following conditions :
(a) The District shall match any State funds made available
on a 50-50 basis,
(b) The money shall be repaid to the State according to the
terms of the existing repayment contract between the
District and the State, with title in a portion of the
water rights to be acquired being vested in the state
for the duration of the contract,
(c) Any water rights to be acquired shall be appraised at
the District' s expense by the appraiser or appraisers of
the staff's choice and the sale price shall be subject
to the staff's advance approval , and
(d) Board funds shall not be made available until change of
water right proceedings have been completed by the
District to the Board 's satisfaction.
