Transmittal of Recommendations Pursuant to Section
37-95-107
Introduction
Section 37-95-107, CRS 1973, as amended (copy enclosed) ,
governs the procedure by which feasibility studies are reviewed
by the CWCB and forwarded to the General Assembly for the benefit
of- the Colorado Water Resources and Power Development Authority.
The Authority cannot finance the construction of a project until
authorized by the General Assembly to proceed .
Sub-section (3) provides that feasibilty studies my be
initiated either by the Authority or by the Board. The Board can
initiate a study in one of three ways : ( 1 ) upon its own
volition, ( 2) at the request of the Authority, or (3) at the
direction of the General Assembly.
Sub-section (4) states that :
Upon receipt of a feasibilty study by the
. . . Board, said Board shall review such
study and forward the study to the General
Assembly together with its recommendaton as
to whether or not the proposed project should
be authorized by the General Assembly.
The means of authorization is then prescribed by sub-section
( 5) . Sub-sections ( 5) and (6) specify that the decision to
finance a project, and the terms and conditions of financing, are
at the sole discretion of the Authority.
