Discussion <br /> In my opinion, sub-sections (3) and ( 4) contemplate that any <br /> and all feasibility studies prepared by the CWCB should be <br /> forwarded to the General Assembly. This includes studies <br /> prepared by the Board "upon its own volition" as part of the <br /> Board 's construction fund program. Although the Board and/or a <br /> project sponsor may not anticipate that a project will be <br /> : : <br /> tl financed by the Authority, that decision lies solely with the <br /> Authority pursuant to sub-sections ( 5) and (6) . <br /> The Board's role would appear to be one of determining <br /> whether a project is technically feasible and desirable in terms <br /> of the development and conservation of Colorado's water <br /> resources. If found feasible and desirable, the Board 's <br /> recommendation to the General Assembly should be that the <br /> Authority be authorized "to proceed with the consideration" of a <br /> project. <br /> In light of the above, it appears that the studies for all <br /> seven projects acted upon by the Board at its January meeting <br /> should be forwarded to the General Assembly. Although the <br /> sponsor of the Stagecoach Reservoir project is the only project <br /> proponent which has indicated an interest in seeking funding from <br /> the Authority, it is not for the Board to judge which projects <br /> the Authority should or should not finance. <br /> Recommendation <br /> I recommend that the enclosed letter of transmittal be <br /> approved. <br /> JWM/gl <br /> Enclosures : as stated <br /> cc : Ival Goslin <br /> MEMORANDUM -2- 3/1/83 <br />
