3. Cache la Poudre River <br /> Mr. Johnson moved, seconded by Mr. Wright, that the <br /> Board take the position that: <br /> The reservation of water established by the <br /> inclusion of portions of the Piedra river in <br /> the national wild and scenic river system is a <br /> reservation which arises expressly from and <br /> only from the act designating the river for <br /> inclusion. The reservation must be expressly <br /> limited to the act designating the river for <br /> inclusion and have no general applicability to <br /> other rivers under consideration. <br /> The Board supports a case-by-case process for <br /> making the determination. If HR 3547 <br /> accomplishes this goal then the Board supports <br /> the legislation. <br /> The motion was adopted, with one member voting no. <br /> 4 . General Position on all Rivers <br /> Mr. Lochhead moved, seconded by Mr. Johnston, that the <br /> Board take the position that: <br /> Colorado' s rivers should not be designated for <br /> inclusion in the national wild and scenic <br /> rivers system unless and until the issues <br /> surrounding the consequences of such <br /> designation are resolved on a river-by-river <br /> basis, particularly as regards the reservation <br /> of water which designation may result in. Any <br /> legislation which would designate a river for <br /> inclusion in the national system should <br /> expressly resolve water rights issues, <br /> including any reservation of water, if any, <br /> for all federal purposes resulting from such <br /> designation. <br /> The motion was adopted unanimously. <br /> Mr. Johnston further moved, seconded by Mr. Johnson, that <br /> the Board request the Congressional delegation to provide it with <br /> opportunity for involvement and comment on proposed wild and <br /> scenic river designations in order that the Board can ensure that <br /> local agreements on individual rivers do not adversely affect or <br /> otherwise apply to other rivers. The motion was adopted <br /> unanimously. <br /> -5- <br />
