3. Cache la Poudre River
Mr. Johnson moved, seconded by Mr. Wright, that the
Board take the position that:
The reservation of water established by the
inclusion of portions of the Piedra river in
the national wild and scenic river system is a
reservation which arises expressly from and
only from the act designating the river for
inclusion. The reservation must be expressly
limited to the act designating the river for
inclusion and have no general applicability to
other rivers under consideration.
The Board supports a case-by-case process for
making the determination. If HR 3547
accomplishes this goal then the Board supports
the legislation.
The motion was adopted, with one member voting no.
4 . General Position on all Rivers
Mr. Lochhead moved, seconded by Mr. Johnston, that the
Board take the position that:
Colorado' s rivers should not be designated for
inclusion in the national wild and scenic
rivers system unless and until the issues
surrounding the consequences of such
designation are resolved on a river-by-river
basis, particularly as regards the reservation
of water which designation may result in. Any
legislation which would designate a river for
inclusion in the national system should
expressly resolve water rights issues,
including any reservation of water, if any,
for all federal purposes resulting from such
designation.
The motion was adopted unanimously.
Mr. Johnston further moved, seconded by Mr. Johnson, that
the Board request the Congressional delegation to provide it with
opportunity for involvement and comment on proposed wild and
scenic river designations in order that the Board can ensure that
local agreements on individual rivers do not adversely affect or
otherwise apply to other rivers. The motion was adopted
unanimously.
