ARCA Annual Meeting 23 <br /> December 14, 1993 <br /> S <br /> 1 MR. HAYZLETT: Pope. <br /> 2 CHAIRMAN COOLEY: Pope. You did such a good job I thought it fitted you <br /> 3 there. The Operations Committee, who will be chairman? <br /> 4 MR. ROGERS: Randy. Randy will chair. <br /> 5 CHAIRMAN COOLEY: Mr. Hayzlett will chair. <br /> 6 MR. ROGERS: And I am the other one. <br /> 7 CHAIRMAN COOLEY: And Mr. Rogers will go along. <br /> 8 So the respective chairs will be Mr. Lile, Mr. Genova and Mr. Hayzlett of the three committees. <br /> 9 Does any comment need to be made or any further action taken on that? They are <br /> 10 appointed. I would think that would do it according to the tradition. <br /> 11 Assuming that the draft report by the Special Master is given prior to December <br /> 11112 10, 1993, we would have a delicious, intense synthesis or discussion of the status of Kansas vs. <br /> 13 Colorado. I take it that that would not be highly appropriate but at the same time for the benefit <br /> 14 of all here, Mr. Draper, would you be kind enough in a paragraph or two to say where we are in <br /> 15 the litigation? <br /> 16 JOHN DRAPER: Yes, I would be glad to. Just to review briefly what's <br /> 17 happened in the litigation since the last annual meeting. The presentation of evidence was <br /> 18 completed last December, and between that time and the end of May the parties filed briefs with <br /> 19 the Special Master. Later in the summer the parties addressed certain questions that the Master <br /> 20 had after the briefing. We are concluding some final evidentiary questions that are unresolved <br /> 21 but are essentially housekeeping matters and the case has been submitted and we're simply <br /> 22 waiting now for a draft report. We expect a draft report from the Special Master, after which he <br /> .23 would hear‘the comments and argument of the parties before finalizing that and submitting it to <br /> 24 the Supreme Court. So that's about where things sit at the moment. <br />
