Jencsok reported on this item by summarizing the facts <br /> as set forth in Mr . McDonald ' s memorandum to the Board dated <br /> November 5, 1984 . <br /> Following Board discussion, Mr . Robbins moved, seconded by <br /> Mr . Lochhead that the Board authorize the Attorney General to <br /> enter into a stipulation with the Adolph Coors Company for the <br /> Board ' s water right application on Leavenworth Creek so long as <br /> that stipulation does no more than state what the law is with <br /> regard to the instream flow appropriation being sought by the <br /> Board. Motion adopted unanimously. <br /> Mr . Vandemoer moved, seconded by Mr . Robbins, that the <br /> Board not file water rights applications for instream flows on <br /> Leavenworth Creek until the study of a potential reservoir <br /> being conducted jointly by the Adolph Coors Company and the <br /> Town of Idaho Springs is completed . Motion adopted unanimously. <br /> Agenda Item 11 - Bear Creek Reservoir Space Allocation - <br /> Appendix E <br /> • In his report on this item, Mr . McDonald recalled the Board <br /> discussions at the July and September 1984 Board meetings <br /> concerning the interest expressed by several local entities to <br /> acquire allocation of space in Bear Creek Reservoir for <br /> conservation storage space. In a response to an earlier Board <br /> request, the Corps indicated that a final determination on the <br /> availability and allocation of space was awaiting the <br /> completion of the Corps ' Denver Tri-Lakes System Operation <br /> Study. <br /> Preliminary results of the study were received from the <br /> Corps early in November . However, a complete report and final <br /> analysis is still being prepared. The preliminary data <br /> received raise a number of questions and, consequently, it was <br /> not possible to prepare a thorough analysis and study results <br /> for the November meeting. <br /> No formal motion was offered . Consensus of the Board was <br /> that the staff should continue working with all interested <br /> parties to finalize the determination as to the availability of <br /> space for water conservation purposes in Bear Creek Reservoir <br /> and to determine a plan for the allocation of any available <br /> space to interested parties . <br /> -9- <br />
