Agenda Item 12 - Proposed Colorado River Floodway Protection Act <br /> (H. R. 5055, 98th Congress) - Appendix F • <br /> At the May 4, 1984, meeting, the Board reviewed and <br /> discussed H.R. 5055, a bill introduced by Congressman Cheney <br /> (Wyoming) and co-sponsored by Congressman Udall (Arizona) . <br /> This bill was intended to accomplish the following: <br /> 1. Formally designate a floodway for the Colorado River <br /> between Hoover Dam and the U.S. - Mexico border, <br /> 2 . Prohibit most forms of future federal financial <br /> assistance to persons and developments in the designated <br /> floodway, <br /> 3 . Prohibit the lease of lands owned by the federal <br /> government within the designated floodway, and <br /> 4 . Establish a Colorado River Floodway Task Force that <br /> would be charged with preparing recommendations for the <br /> management of the Colorado River Floodway, including the means <br /> of restoring a 40, 000 cfs capacity floodway at Hoover Dam (and <br /> correspondingly larger capacities downstream to reflect <br /> tributary inflow) and the necessity for additional floodway <br /> management legislation at local , state, and federal levels . <br /> No action was taken on this bill during the past session. • <br /> However, according to advice from Washington, the bill will be <br /> introduced next year with the revisions which the Lower Basin <br /> states believe are needed to avoid unintended effects on some <br /> activities in the floodplain. <br /> Copies of the amended version of the proposed bill have <br /> been received. No significant changes in the major features of <br /> the bill have been made. Discussions by the Lower and Upper <br /> Basin states on the proposed bill are expected to take place in <br /> December, at which time a seven-state position on the bill will <br /> be sought. <br /> In a related matter, Senator DeConcini (Arizona) introduced <br /> a bill (S 2918) late in the past session which would have done <br /> nothing more than create a task force to study the problem of <br /> restoring the floodway. <br /> Mr . Lochhead moved, seconded by Mr . Getches, that the Board <br /> approve the staff recommendations as follows : <br /> (1) The Board reaffirm its support for the general <br /> provisions of H.R. 5055, with the amendments proposed by the <br /> Lower.
