Vandemoer, that the Board • <br /> approve this study subject to a technical review by local <br /> government staff and that Mr. McDonald seek advice from the <br /> Attorney General ' s office on the liability question. Motion <br /> adopted unanimously. <br /> Added Agenda Item - Corps of Engineers Small <br /> Flood Control Projects <br /> Mr. McDonald reported on the current Corps of Engineers <br /> policy concerning financing study costs for such projects which <br /> now requires local or state cost-sharing. <br /> Following Board discussion, Mr. McDonald stated that no <br /> Board action was necessary at this time, instead he will work <br /> with the Corps to attempt to resolve legal and other issues with <br /> reference to this problem. <br /> Added Agenda Item - Conservation Storage - Bear Creek and <br /> Chatfield Reservoirs <br /> Mr. McDonald referred to the preliminary conclusion reached <br /> early last year by the Corps of Engineers that conservation space <br /> may be available in Bear Creek and Chatfield Reservoirs . In <br /> later meetings between the Corps, state officials and other <br /> entities, this issue was raised and was being addressed in a • <br /> Corps study which was then scheduled for completion in September, <br /> 1984. He also indicated that the City of Lakewood, the Central <br /> Colorado Water Conservancy District, and a number of additional <br /> entities have expressed interest in obtaining storage space in <br /> Bear Creek Reservoir. In light of these circumstances, it has <br /> become quite important that the Corps reach a final decision on <br /> whether space is available in Bear Creek Reservoir. <br /> Following Board discussion, Mr. McDonald recommended that <br /> the Board authorize him to communicate with the Corps, <br /> emphasizing (1) the urgency in this matter, (2) that it is the <br /> Board' s position that the intended flood protection benefits of <br /> Bear Creek Reservoir must not be reduced by the reallocation of <br /> space to water conservation storage, (3) that the Board strongly <br /> supports the use of Bear Creek Reservoir for water conservation <br /> storage if space can be allocated to that purpose without <br /> reducing the flood control protection which the project is to <br /> provide, and (4) if it is found that space is available, the <br /> Board proposes to take responsibility for bringing together the <br /> interested parties to resolve issues concerning the allocation of <br /> available space and for working with the Corps on the resolution <br /> of the other issues. <br /> • <br /> -6- <br />
