6) Reserved Rights - Instream Flows • <br /> (a) Antedation of Claims in Water Divisions 1, 2 and 3 <br /> and Naval Oil Shale. <br /> (b) Dinosaur National Monument (Colorado has filed for <br /> summary judgment. United States has filed its <br /> quantification) . <br /> (c) Instream Flows (U.S. Forest Service to file claims <br /> in July and August 1984 in Water Division 3 - State <br /> will file summary judgment) . <br /> (d) Federal filings to change water rights above Aspen <br /> to instream flow uses . <br /> Following Board discussion of this latter item, Mr. Robbins <br /> moved, seconded by Mr. Getches, that the Board file a Statement <br /> of Opposition in diligence for purpose of ascertaining diligence. <br /> Mr. Lochhead moved to amend motion providing for the Board to <br /> file as co-applicant, or alternatively, file a Statement of <br /> Opposition and that the Attorney General contact the Departments <br /> of Justice and Agriculture by letter to discuss the Board ' s <br /> proposal to file as co-applicant and express the State' s <br /> displeasure for lack of cooperation by the Federal Government but <br /> indicating the State' s willingness to resolve this issue . Mr. <br /> Robbins accepted the amended motion and it was adopted • <br /> unanimously by voice vote. <br /> 7 . Indian Reserved Rights . <br /> Mr. Paddock called attention to the funding problems <br /> encountered by the Attorney General ' s office in carrying out this <br /> activity and that funds will be depleted by September or October. <br /> Following Board discussion of this problem, Mr. Robbins moved, <br /> seconded by Mr. Getches, that Mr. McDonald send a letter <br /> to Mr. Woodard requesting that the Attorney General obtain input <br /> from Messrs . Getches, Danielson and McDonald on how best to <br /> resolve this funding problem. Motion adopted unanimously. <br /> 8. Taylor Draw Reservoir Power Right (no need for further <br /> Board action) . <br /> At this point in the meeting, Mr. Furneaux moved, seconded <br /> by Mr . Vandemoer, that the order of the agenda be changed to <br /> allow consideration of Case #4-84CW053, "Change of Water Right <br /> and Plan for Augmentation, " filed by applicants W.
