paragraph H. <br /> THE REFEREE HEREBY RULES: <br /> A. The Findings of Fact and Conclusions of Law set forth above <br /> are incorporated in this Ruling. <br /> B. This Application was filed properly and the Referee has <br /> jurisdiction of this case. Time for filing further Statements of <br /> Opposition has expired. <br /> C. The Application for a Change of Point of Diversion and Change <br /> of Use is one contemplated by law, and, if administered in accordance <br /> with this Decree and the conditions imposed, will permit the usage of <br /> this water without adversely affecting any vested water rights. The <br /> Application is approved subject to the conditions herein stated. <br /> D. The Applicant shall perform those duties which it has agreed <br /> to as imposed by the above Findings of Fact and Conclusions of Law. <br /> E. The State Engineer, the Division Engineer and his <br /> subordinates, and other water administration officials shall <br /> administer the subject water right in accordance with this Ruling. <br /> F. The Leyner Cottonwood Consolidated Ditch Co. 's Decrees are <br /> changed as to the use and place of use for the Applicant's pro rata <br /> share of water under these Decrees. <br /> G. The Court shall retain continuing jurisdiction pursuant to <br /> C.R.S. 1973 S37-92-304(6) , as amended to the date of this Decree, for <br /> a period not to exceed five years, in order to assure that no material <br /> injury occurs to vested water and decreed conditional water rights. <br /> This Ruling and Decree shall become final, however, under its own <br /> terms, five years from the date it is signed by the Water Judge, <br /> 8 <br />
