may divert no more than 419 acre feet of this transferred <br /> water right during the first five years of the operation of <br /> this decree. <br /> (7) Minimum Flows. This change of water right is <br /> subordinated to the water right of the Colorado Water <br /> Conservation Board on behalf of the People of the State of <br /> Colorado as described in a Decree applied for in Case No. <br /> 80-CW-379 of this Division; provided, however (a) this <br /> subordination is only effective after a Decree is entered in <br /> Case No. 80-CW-379 and (b) this subordination is effective <br /> only as to the flows therein decreed but not more than a <br /> maximum minimum stream flow of 15 cubic feet of water per <br /> second of time from May 1st through September 30th; and 6 <br /> cubic feet of water per second of time as it pertains to a <br /> minimum stream flow between the outlet of Gross Reservoir <br /> and the stream flow measuring station located in the SE 1/4 <br /> of Section 26, Township 1 South, Range 71 West, Boulder <br /> County, Colorado, approximately one mile west of Eldorado <br /> Springs, and 2 cubic feet of water per second of time below <br /> said stream flow measuring station from October 1st to May <br /> 1st. The downstream terminus of this applied for water <br /> right of the Colorado Water Conservation Board shall be the <br /> intersection of South Boulder Creek and South Boulder Road. <br /> 6. Use of Water: <br /> The use of water is hereby changed to municipal purposes, <br /> including irrigation, lawn watering, domestic, fire protection, <br /> recreational and all other beneficial uses incidental to Erie's <br /> municipal water system. The water shall be diverted out of South <br /> Boulder Canyon Ditch into Erie's treatment plant, into Erie Lake, <br /> Prince Lake No. 1 and other storage facilities, or applied directly to <br /> municipal purposes within the corporate limits of the Town of Erie. <br /> This water may also be reused or successively used prior to its return <br /> to a naturally tributary stream; provided, however, prior to <br /> institution of a Plan of Reuse or Successive Use the Applicant shall <br /> give 60 days written notice (by certified mail, return receipt <br /> requested) to the parties of record describing its Plan of Reuse or <br /> Successive Use. If a party objects to the proposed Plan of Reuse or <br /> Successive Use, it may file a Petition with the Court pursuant to <br /> 7 <br />
