9 . Mr . McDonald reported on the Arkansas River Compact <br /> administration meeting at Garden City, Kansas in late March. The <br /> State of Kansas contends that the operation of Trinidad and <br /> Pueblo Reservoirs by Colorado has not been in conformance with <br /> the Arkansas River Compact . <br /> Attorney General ' s Report <br /> In his remarks , Attorney General Duane Woodard stressed his <br /> budget problems and concern for water problems particularly with <br /> reference to upcoming requirements in the U. S. Reserved Rights <br /> litigation. This concern stems from the reduction in funds <br /> contained in the Long Bill . Following discussion of this <br /> problem, Mr . Robbins moved, seconded by Mr . Jackson, that <br /> Director McDonald be directed to write a letter to the Senate and <br /> House leadership, copy to the Joint Budget Committee , calling <br /> attention to this probable litigation and the lack of funds for <br /> legal services . The motion was approved unanimously. <br /> Mr . Woodward called upon Mr . Bill Paddock, Assistant <br /> Attorney General , Natural Resources , to report on several legal <br /> water issues of interest to the Board . These include : <br /> 1. Staff Changes <br /> 2. Colorado Versus New Mexico (Vermijo Case) <br /> 3. Arizona Versus California decision ( Indian Water Rights) <br /> 4. National Wildlife Federation versus Marsh ( 404 Permits) <br /> 5. TAR versus Animas-La Plata Water Conservancy District <br /> (Legislation Validating Conservancy District being <br /> challenged) <br /> 6. Federal Reserved Rights preparation and litigation . <br /> 7. Jones Hole Fish Hatchery Suit on behalf of Division of <br /> Wildlife <br /> 8. Wyoming water right application on Little Snake River . <br /> Discusion followed concerning the Board ' s position on <br /> intervention in litigation involving water issues , particularly <br /> with reference to item 4 above . Questions were raised as to <br /> availability of funds and the Board 's priorities . Thereupon , <br /> Mr . Robbins moved , seconded by Mr . Vandemoer , that the Director <br /> be authorized to intervene in the National Wildlife Federation <br /> Versus Marsh litigation after receiving advice from the Attorney <br /> General. The motion was adopted unanimously. <br /> Mr . Johnson moved, seconded by Mr . Furneaux, directing Mr . <br /> McDonald to write a letter to the Legislative leadership <br /> -3- <br />
