4.5 UNAUTHORIZED USE OF A FIRE HYDRANT. Use of any fire <br /> hydrant owned by the company for purposes other than fighting fire requires a written <br /> permit from the Company, signed by an authorized employee of the Company. Among <br /> other items which may be required by the Commission, the permit will include the <br /> ownership, make, license number, and water load capacity of any vehicles which will <br /> carry hydrant water, the duration of the permit, and the location of the construction or <br /> other activity for which the water will be used. A copy of the permit must be kept in any <br /> permitted vehicle at all times during the length of the permit. <br /> ARTICLE V. VIOLATIONS OF THE RULES AND REGULATIONS <br /> 5.1 Any person violating any of the provisions of these Rules and Regulations shall be liable <br /> to the Commission for any expense, loss or damage occasioned by reason of the <br /> violation. <br /> 5.2 The customer shall pay be responsible for any court expenses or reasonable legal fees <br /> incurred by the Company in enforcing the terms and conditions of these Rules and <br /> Regulations. <br /> ARTICLE VI. WATER TAPS AND FEES <br /> TAP FEES <br /> 6.1 The customer shall pay one residential tap fee for each residential unit on the customer's <br /> property and/or one commercial tap fee for each commercial unit on the customer's <br /> property at rates set forth in Appendix A. <br /> 6.2 The customer shall pay an additional tap fee in the event they install an internal fire <br /> protection system on the property. <br /> TAPS <br /> 6.3 The customer is responsible for the payment of all equipment and construction charges <br /> related to the installation of one residential water tap/connection for each residential unit <br /> on the customer's property and/or one commercial tap/connection for each commercial <br /> unit on the customer's property. <br /> The Commission may, at its discretion, grant a variance and permit fewer than one tap <br /> per residential or commercial unit to serve the customer's property. In making such a <br /> determination the Commission may consider factors including, but not limited to, <br /> convenience to ultimate consumers, engineering feasibility, and maintenance and repair <br /> difficulties. The customer, however, shall pay a tap fee for each residential or <br /> commercial unit regardless of the number of physical taps. <br /> 6.4 Each tap/connection to the Company's distribution lines shall be metered. <br /> 6 <br />
