A. This agreement shall become effective upon approval by the State Controller or his
designee and remain in force through September 30, 2007, which is the period during
which authority has been granted to the Secretary of the Interior, acting through the
Bureau of Reclamation under Section 3 (a) (2) of P.L. 106-392 to implement capital
construction projects under the UCRIP and SJRIP. The federal authority expires at the
end of FY 2007 unless reauthorized by Act of Congress, in which case this Contract
maybe extended by mutual agreement of the parties.
B. Annual Renewal: Pending the appropriation of funds for this contract by the Colorado
Legislature for this purpose, and contingent upon the availability of other cost share
funds, this contract may be amended annually through federal FY 2007 to include the
additional funding.
C. The contract may be extended to cover work authorized but not completed through the
following federal fiscal year(FY 2008) so long as funds remain authorized and
available.
5. METHOD OF PAYMENT
The State shall fund this Contract by advancing funds using the procedure set forth below.
The amount of each advance will be not less than the sum shown as the requirement on the
approved annual work plan, less any estimated balance of funds available from prior
advances as appropriate. The payment of funds by the State in accordance with this Contract
is dependent upon the continued appropriation and availability of such funds by the Colorado
Legislature. The State shall not be obligated to pay any of the amounts billed for services
performed in accordance with this Contract unless and until funds have been appropriated for
such purpose, and such obligation shall not exceed the amount of such appropriation if less
than the Contract limits specified above.
The State may advance funds to the Foundation to cover estimated costs, limited to the
amounts necessary for immediate disbursement needs during either the first six months of or
for an entire fiscal year, with such advances timed to be in accord with the actual immediate
cash requirements of the Foundation in carrying out the purposes of the Contract. All funds
advanced remain funds of the State until expended and all interest on such funds accrues to
the State. Upon termination or completion of this contract, any funds not expended shall be
returned to the State. Requests for advance funds should be sent to the State 45 days prior to
initiating any work program activities, to allow adequate time for review and processing of
the request.
A. Prerequisites for advances from the State are:
1. Approval by the State's Representative appointed under 3.B.2 herein of the annual
work schedule.
2. A completed Request for Advance Form.
3. Review and approval by the designated Field Engineer of the Request for Advance
Form.
