YAMPA DETAILED STUDY MOU <br /> February 22 , 1993 <br /> Page 8 <br /> (2) The amount of water of the Juniper Decree <br /> offered for conversion to instream flow shall be <br /> determined by the River District, taking into <br /> consideration the decrees entered in Cases 83CW143 <br /> and 91CW31, in Water Division No. 6, and other <br /> relevant decrees and information. <br /> (3) Any Instream Flow based on decree(s) offered <br /> by the CRWCD shall meet and fulfill all Federal <br /> requirements on the Yampa River below Hayden <br /> concerning further water resources development in <br /> the Yampa River Basin, including but not limited <br /> to Wild and Scenic Rivers Act, Endangered Species <br /> Act, National Parks, and Wilderness Areas. <br /> (4) Conversion of a portion of the Juniper Decree <br /> to an Instream Flow will be sufficient progress <br /> towards recovery under the Recovery Implementation <br /> Program and the Endangered Species Act when the <br /> USFWS considers development of Colorado's full <br /> compact entitlements on the mainstem and all <br /> tributaries of the Colorado River which are within <br /> the Colorado River Water Conservation District. <br />
