YAMPA DETAILED STUDY MOU <br /> February 22 , 1993 <br /> Page 9 <br /> (5) The mechanism and consideration for <br /> transferring portions of the Juniper Decree shall <br /> be negotiated by the CRWCD with those seeking to <br /> acquire those portions for instream flow purposes. <br /> B. The CWCB shall determine the terms and conditions <br /> under which it will accept any portion of the <br /> Juniper decree offered by the Colorado River Water <br /> Conservation District for conversion to an instream <br /> flow pursuant to its statutes and the "Guidelines <br /> and Procedures Concerning the Acquisition of <br /> Conditional Water Rights for Change to Absolute <br /> Instream Flow Water Rights" as approved by the <br /> Colorado Water Conservation Board on November 14 , <br /> 1991 or any applicable regulations or guideline <br /> revisions. <br /> C. The U. S. Department of Interior (USFWS and USBR) <br /> will determine if the available and convertible <br /> portion of the Juniper decrees will contribute to <br /> the Recovery Implementation Program meeting its <br /> goals to recover the endangered fish.
