2.4 The Contractor desires to purchase, and Reclamation and Western are willing to
furnish, firm electric service under the terms and conditions stated herein.
2.5 The firm electric service furnished to the Contractor under this Contract for use
by the Animas -La Plata Project is furnished consistent with provisions of the
March 26, 1980, Agreement between Western and Reclamation attached hereto as
Attachment No. 1.
2.6 The power and energy required by the Project operating components have been
reserved by Western for Reclamation for use at the Animas -La Plata pumping
plant as Other Priority Use Power, which is power reserved by Reclamation for
project purposes and used for pressurizing sprinkler irrigation systems or for
municipal and industrial use.
2.7 The Energy Planning and Management Program, published by Western in the
Federal Register at 60 FR 54151, dated October 20, 1995, as it may be amended
or superseded, hereinafter referred to as the Program, implements the
requirements of Section 114, Title I of the Energy Policy Act of 1992. The
Program requires the Contractor to develop, or cause to be developed, an
Integrated Resource Plan (IRP), or a Small Customer Plan.
