SECWCD February 16, 2006 9 RECORD OF PROCEEDING DIRECTOR OF ENGINEERING & RESOURCES MANAGEMENT REPORT: Water Resume Report Mr. Hamilton did a follow up of the November 2005 R6sum6 in Water Division 2. He said there are two (2) cases in the November R6sum6 that required follow up. 1. Case 05CW86: XCEL Energy's application for Finding of Reasonable Diligence for the Southeast Plant Reservoir in Bent County. Legal counsel did execute a stipulation with XCEL that reaffirms previous stipulations. 2. Case 05CW87: The Board of Water Works of Pueblo's (BWWP) application for Finding of Reasonable Diligence for the local exchange of "sewered" transmountain return flows. The District signed a letter agreement with BWWP that insures that the appropriate Fry -Ark protective language will be included in the diligence decree. In the December 2005 Resume Water Division 2 Mr. Hamilton did a follow up on Case 05CW95: Colorado Springs Utilities (CS -U) application for Exchanges. a. The exchanges are from: 1. Pueblo Reservoir 2. Proposed Southern Delivery Return Flow Pipeline b. To a point on the Arkansas River between the Canon City Hydraulic Ditch headgate and the Pueblo /Fremont County line. c. The sources of water for the exchanges are: 1. Any water owned, controlled, or available for use by CS -U that is stored in Pueblo Reservoir. 2. Water returned to the Arkansas River via the proposed SDS return flow pipeline. Mr. Hamilton reported in Case 05CW96: Colorado Springs Utilities (CS -U) application for Exchanges: a. The exchanges are from: 1. Pueblo Reservoir 2. Proposed Southern Delivery Return Flow Pipeline 3. The confluence of Fountain Creek and the Arkansas River b. To any of the following sites: 1. Turquoise Reservoir 2. Twin Lakes Reservoir 3. Otero Pump Station intake 4. Upper Homestake Pipeline
