Elephant Rock Reservoir Project <br />Mr. Hamilton said the sources of water for these exchanges are "Temporary Use Agreement <br />Waters" and their associated return flows. <br />Mr. Hamilton recommended that the District file statements of opposition in cases 05CW95 and <br />05CW96. Mr. Long moved, seconded by Mr. Reed, to file statements of opposition in cases <br />05CW95 and 05CW96. Motion unanimously carried. <br />Mr. Hamilton reported on Case 05CW 105; Rocky Ford High Line Canal Company and the City of <br />Aurora's Application for Appropriative Rights of Exchange. Legal counsel discussed this <br />application at the last meeting. This Application includes existing exchanges from the Rocky Ford <br />High Line Canal headgate to Pueblo Reservoir and from Pueblo Reservoir to Twin Lakes. Other <br />exchanges in this application are conditional, from the High Line Canal headgate upstream to <br />various locations including: <br />a. Pueblo Reservoir <br />c. Otero Pump Station <br />e. Proposed Box Creek Reservoir <br />b. Arkansas gravel Pit Reservoir <br />d. Twin Lakes <br />f. Turquoise Reservoir <br />Mr. Hamilton recommended that the District file a statement of opposition in the Aurora/High Line <br />Canal Company case 05CW105. Mr. Goodwin moved, seconded by Mr. Genova, to file a statement <br />of opposition in case 05CW105. Motion unanimously carried. <br />Mr. Hamilton reviewed Case 06CW 107; City of Lamar's Application for a change of water rights <br />and Appropriative Rights of Exchange in Prowers, Bent, Otero, and Pueblo Counties. This <br />application is for the change of Lamar's Fort Bent Ditch shares and for exchanges from the Fort <br />Bent Ditch Clay Creek augmentation station to the Fort Bent Ditch headgate, Pueblo Reservoir, and <br />John Martin Reservoir. <br />Mr. Hamilton recommended that the District file a "friendly" statement of opposition in the City of <br />Lamar case to insure settlement of this case are consistent with that recent settlements with Lower <br />Arkansas Water Management Association (LAWMA) concerning the Fort Bent Ditch, that the <br />District's interests in Pueblo Reservoir are protected, and that Lamar follows proper Compact <br />procedures for changing water rights from below to above John Martin. Howard Miller moved, <br />seconded by Mr. Genova, the District file a "friendly" statement of opposition in case 05CW107. <br />Motion unanimously carried. <br />Mr. Hamilton reported in the December 2005 R6sum6 Water Division 5, Case 05CW296, West <br />Divide and Silt Water Conservancy Districts, that the District authorize legal counsel to execute a <br />stipulation with the applicants in Water Division 5 case 05CW296, with back -up authority to extend <br />
