WHEREAS, Reclamation and the Basin States wish to staff a <br />"Steering Committee" which shall be formed to provide direction <br />in the development of said Program Plan. <br />NOW, THEREFORE, in consideration of the mutual covenants <br />herein contained$. Reclamation and the Basin States hereto agree <br />as follows: <br />3. a. To the extent that funds are advanced by the Cooperating <br />Partners through the Agreement, and that Federal funds are <br />available for this purpose, Reclamation shall, with its staff, <br />use said funds to complete the development of the Program Plan as <br />set forth in the Scope of Services (Attachment B) and as directed <br />by the Steering Committee described in this MOU. <br />b. Upon completion, Reclamation shall transmit to the Basin <br />Staten and Cooperating Partners, its final Program Plan as <br />scheduled, which may be used for a precipitation management <br />demonstration activity should such an activity be authorized. <br />4. a. The total payments made by the Cooperating Partners as <br />provided in the Agreement shall not exceed $91,000. These <br />payments when combined with Federal funds in the amount of <br />$94,404 are estimated to permit the completion of the Program <br />Plan as set forth in Attachment B. Adjustments in the details of <br />the Program Plan specified in Attachment B, with the consensus of <br />the Steering Committee, may be necessary to assure that the <br />Program Plan is completed within the monies hereby provided. <br />S. a. The Basin States hereby agree that Reclamation shall be <br />the Project Manager and shall perform and carry out the duties <br />and responsibilities required of the Project Manager under this <br />MOU. <br />b. Subject only to the express limitations of this MOU and <br />the Agreement, the approval of the Steering Committee, the <br />Project Manager is authorized in the development of the Program <br />Plan to incur costs, liabilities, and obligations up to the <br />amounts approved and funded by the Parties to the Agreement and <br />to perform or arrange for the performance of study <br />investigations. <br />10 <br />
