Bureau of Reclamation <br />Denver 1, Colorado <br />Dear Mr, Batson; <br />The following constitutes my comments on your "Definite Plan Report" <br />on Glendo tTnit Oregon Trail Division of the North Platte River District, <br />Missouri River Basin Project. <br />I note mention in Paragraph 1'his your <br />letterletter <br />lloincludemcotiments on the the Fremont Canyon power plan. 2 <br />proposed Glendo Unit only. <br />In Paragraph 2. of your letter you state that the Glendo Unit was <br />authorized for construction as a unit of the iIlissouri River Basin <br />Project by the 1944 Flood Control Act. We are reliably informed that <br />all projects listed in this Act were supposed to be reviewed by the <br />states prior to the final authorization. We note that the so- called <br />"original authorization" provided for a storage capacity of approximately <br />150,000 acre feet, but that subsequent investigations have disclosed <br />the necessity for increasing the capacity to 800,000 acre feet in <br />order to provide flood control in the highly developed area downstream <br />in both.Wyoming and Nebraska and for other reasons, <br />We also note that the 1949 Appropriation Act provided that ItNo part of <br />this appropriation shall be used for surveys, designs, or construction <br />of the Glendo Project, Wyoming, or any feature thereof to a greater <br />capacity or for other purposes than set forth in Senate Document No.-191, <br />78th Congress:, 2nd Session v& thout the specific authorization of the <br />Congress ". <br />The 1950 Appropriation Act 81st Congress, ist Session, provided that: <br />"in order to promote agreement among the states of Nebraska, Wyoming and <br />Colorado, and to.avoid any possible alteration of existing vested rights, <br />no part of this or of any prior appropriation shall be used for con- <br />struction or for further commitment for construction of the Glendo Unit <br />
