Cl <br />Re <br />Summary of Application. In its Application, CCWCD seeks a decree for a conditional <br />;e water right known as the London Mining and Smelter Ditch Enlargement. CCWCD also <br />a decree for a conditional water storage right known as the London Mining and Smelter <br />voir 1St Enlargement. <br />7. 1 Description of Conditional Surface Water Right. CCWCD is granted a conditional <br />surf *e water right as follows: <br />7.1. Name of Surface Water Right. London Mining and Smelter Ditch Enlargement. <br />7.2. Legal Description of Structure. The London Mining and Smelter Ditch <br />; ement is located on the left bank of Mosquito Creek at a point whence the EIA corner of <br />n 13, Township 9 South, Range 78 West of the 6t" p.m. bears south 58 degrees 30' East <br />feet. <br />7.3. Source. The source of water for the London Mining and Smelter Ditch <br />;ment is Mosquito Creek, tributary to the Middle Fork of the South Platte River. <br />7.4 Appropriation Date. The appropriation date for the London Mining and Smelter <br />Ditc Enlargement is September 2, 2009, based on the adoption of a resolution of CCWCD's <br />Boar I of Directors at its September 2, 2009 meeting that directed the filing of the application and <br />by ol her overt acts demonstrating intent to appropriate this conditional water right. <br />and i7.5. Decreed Amount. The amount of the water right decreed to the London Mining <br />melter Ditch Enlargement is 1.5 c.f.s. conditional. <br />7.6. Decreed Uses. Augmentation, substitution and exchange, domestic, commercial, <br />gal, irrigation, livestock, recreation, fish and wildlife propagation, fire protection, <br />ig the fill and refill of the London Mining and Smelter Reservoir 1St Enlargement. <br />D shall use the water for beneficial purposes within Park County, Colorado. <br />8. Completion of Elements. As to the conditional surface water right granted herein, <br />CC CD has completed all of the elements for the appropriation of a conditional water right, <br />incl ing: (a) formation of the non - speculative intent to appropriate water, (b) performance of <br />ove acts coincidently with this intent to manifest the intention to appropriate water to a <br />bene 1cial use and to demonstrate the taking of a substantial step toward applying water to <br />bene icial use and these acts were of such a nature so as to provide interested third parties with <br />notic o of the nature and extent of the proposed diversion and consequent demand upon the river <br />system; and (c) the proposed uses of water can and will be completed with diligence within a <br />reas nable period of time. <br />9. 1 Description of Conditional Water Storage Right. CCWCD is granted a conditional water <br />storaLe right as follows: <br />9.1. Name of Storage Right.
