BOX 2038 Filing Date: Aug 17 2011 6:50AM MD Filing ID: 39320858 Greeley, CO 80632 CONCERNING THE APPLICATION OF: ♦ COURT USE ONLY CENTER OF COLORADO WATER Case Number 2009CW145 CONSERVANCY DISTRICT IN PARK COUNTY FINDINGS OF FACT, CONCLUSIONS OF LAW, RULING OF THE REFEREE AND DECREE OF THE WATER COURT This matter comes before the Water Referee on the Application for Conditional Surface Water Rights and Conditional Water Storage Right filed by the Center of Colorado Water Conservancy District, and having reviewed said Application and the other pleadings on file and being fully advised on this matter, the Water Referee makes the following findings and orders: FINDINGS OF FACT 1. Applicant. The Applicant herein is the Center of Colorado Water Conservancy District ( "CCWCD "), P.O. Box 1747, Fairplay, Colorado 80440, (719) 836 -2120. 2. Application, Notice and Jurisdiction. The application in this case was filed on October 20, 2009. Timely and adequate notice of the application was given in the manner prescribed by law, and the Court has jurisdiction over the subject matter of this proceeding and over all persons and property affected hereby, whether those persons or owners of property have appeared or not. The lands and water involved in this case are not within the boundaries of a designated groundwater basin. 3. Statements of Opposition. Timely statements of opposition were filed by the City of Aurora and Leadville Water J.V. No other statements of opposition have been filed and the time for filing such statements of opposition has expired. 4. Stipulations. CCWCD has entered into stipulations with the City of Aurora dated June 16, 2011 and Leadville Water J.V. dated August 23, 2010. The Court has reviewed those stipulations and has entered orders approving them. 5. Consultation Report. A Consultation Report of the Division Engineer dated January 28, 2010 was filed with the Court, pursuant to C.R.S. §37 -92- 302(4) and has been considered by the Referee in the entry of this ruling.
