Drive <br />Carbondale, CO 81623 <br />RE: Additional Questions from Patrick & Stowell, P.C. <br />Dear Ms. Wikstrom: <br />As a follow up to our telephone conversation on October 21, 1997, Michael Erion called Patrick <br />& Stowell to clarify speciiically what additional questions needed to be answered for the Blue <br />Lake Homeowners Association regarding the inigation ditches. Michael Erion spoke with Tom <br />Kinney who asked the following questions. <br />1. Are the terms and conditions of the decree and augmentation for Blue Pond and <br />Blue Lake being met by current operation of the system; e.g., is B1ue.Pond being <br />filled by the Harris & Reed Ditch? If not, can it be filled from the Robinson <br />Ditch? <br />2. If the homeowners association accepts the water rights from Vantex, would the <br />physical water supply (flow rate, cfs) be sufficient for a raw water irrigation <br />system? <br />In response to these questions, we offer the following comments. <br />1. The terms and condiiions of the decree and augmentation plan can generaliy bC met <br />with the existing operation and physical characteristics of the Harris & Reed Ditch. <br />Blue Pond �is in fact filled by the Hanis & Reed Ditch. (It is also filled with <br />Robinson Ditch water.) However, the augmentation plan states that the Hanis & <br />Reed Ditch water will be measured in a flume prior to flowing through a splitter <br />box which divides water between that which is used to fill the pond and lake and <br />that which is returned to Blue Creek. The existing system does not measure water <br />prior to filling Blue Pond and prior to the splitter box at Blue Lake. However, <br />there are Parshall flumes measuring water in each direction out of the splitter box. <br />The intent, terms, and conditions of the decree can be met with this anangement. <br />However, Robinson Ditch water is commingled with the Harris & Reed Ditch <br />water prior to the splitter box and complicates the accounting for the Harris & <br />Reed Ditch water.
