General's Office to conduct public hearings and develop a Record of Decision on weather modification <br />permits. Administrative Order 03 -04, created in 2004 by DNR Executive Director Russell George, again <br />delegated the authority to administrate the State of Colorado's weather modification program to the CWCB <br />until revised or rescinded. <br />SUMMARY OF ADMINISTRATIVE RECORD <br />In considering and acting upon the weather modification application by Western Weather Consultants, <br />L.L.C. (WWC) on behalf of the primary project sponsors Southwestern Water Conservation District, San <br />Juan Water Conservancy District, Pagosa Area Water and Sanitation District, Pine River Irrigation District, <br />City of Durango, and Florida River Water Conservancy District the following information was taken into <br />account and is incorporated as part of this Record of Decision. Written testimony, public hearing discussion <br />and comments and submittals are used to aide the Colorado Water Conservation Board (CWCB) and <br />Colorado Attorney General's Office (AGO) in developing the recommendations to approve, approve with <br />conditions, or deny a request for a weather modification permit application. There are audio files for this <br />public hearing that can be accessed by contacting the CWCB and are available over the internet. The public <br />hearing officer did not transcribe statements verbatim, but did try to capture the points being made at the <br />public hearing listed below: <br />1. Exhibit A: Application for Weather Modification Permit, Form WM2, dated June 15, 2010 by <br />Lawrence M. Hjermstad, President of Western Weather Consultants, LLC. <br />• This application included background and qualifications of the operator and an operational <br />plan, with a point -by -point response to the questions asked in the application. <br />• There are several references to scientific publications and policy statements in the WWC <br />permit application and in the Western Weather Consultants (WWC) Power Point from the <br />public hearing. The references to the application and presentation are in this record as Exhibit <br />I. <br />2. Exhibit B: Photocopy of a check for the standard $100 application processing and review fee <br />enclosed in the mailing with the application. <br />3. Exhibit C: Copy of the Agenda from the Public hearing held Monday July 12, 2010 from 12 :00 <br />PM to 2:00 PM in the Pagosa Area Water and Sanitation District Offices board room at 100 Lyn <br />Avenue in Pagosa Springs, Colorado. <br />4. Exhibit D: Notice of intent drafted by WWC and approved by the CWCB and AGO prior to <br />publication in the official newspapers of record in the target area counties and adjacent counties. <br />Proper notification and official proof of public from the newspapers are requirements for a <br />Colorado weather modification permit.
