RECORD OF DECISION <br />ON AN APPLICATION FOR A <br />WEATHER MODIFICATION PERMIT <br />APPLICANT: Lawrence M. Hjermstad, President <br />Western Weather Consultants, L.L.C. <br />P.O. Box 58 <br />Durango, CO 81301 <br />DATE OF APPLICATION: June 15, 2010 <br />PROJECT: Commercial seeding of winter storm clouds with up to 18 ground -based <br />cloud nuclei generators to augment snowpack. This permit request is to <br />operate the program to increase snowpack snow water content to <br />benefit: natural habitat, agriculture, municipal water, stock growers, <br />recreational interests and the local economy. <br />TARGET AREAS: The primary target area is defined as those mountainous areas above <br />9,000 feet mean sea level in the Eastern San Juan Mountains including <br />mountain drainages that drain into the Florida River Pine River, Piedra <br />River, San Juan River, Navajo River and Blanco River. <br />DURATION: The application requests a permit from November 1 through March 31 <br />for the next consecutive ten years, expiring March 31, 2020. <br />DIRECTOR OF OPERATIONS: Lawrence Hjermstad, President, Western Weather Consultants, L.L.C. <br />Mike Hjermstad, Head of Operations, Western Weather Consultants, <br />L.L.C. <br />Eric Hjermstad, Head of Field Operations, Western Weather <br />Consultants, L.L.C. <br />PERMIT SOUGHT: A winter commercial cloud seeding permit pursuant to section 36-20 - <br />112, C.R.S. (2010), for ten years duration pursuant to section 36-20 - <br />114, C.R.S. (2010). <br />ACTION TO BE TAKEN: The findings in this Record of Decision will be developed by a CWCB <br />staff member and a representative from Colorado Attorney General's <br />Office. The recommendation will be either to grant the permit, grant <br />the permit subject to conditions, or deny the permit. <br />DELEGATION OF AUTHORITY <br />Pursuant to the delegation of authority by the Executive Director of the Colorado Department of Natural <br />Resources ( "DNR ") on September 25, 1987 and reaffirmed on October 14, 1992, the Director of the <br />Colorado Water Conservation Board ("CWCB") directed a CWCB staff member and the Colorado Attorney <br />1 <br />
