� <br />� <br /> I� <br />EXHIBIT A <br />Description of Water Riqhts* <br />Ten (10) consumptive acre-feet of water per year out of a total of 361 consumptive acre- <br />� feet, and 0.864 c.f.s. out of a total maximum diversion rate of 31.22 c.f.s., decreed by <br />the District Court in and for Water Division No. 5(the "Water Court"), in Case No. W- <br />217, as being historically attributable to the following described water rights: <br /> li <br /> I� <br />� <br />(a) Rice Ditch, decreed for 4.50 c.f.s. with a May 3, 1893 appropriation date and a March 2, <br />1910 adjudication date. The originally decreed headgate of the Rice Ditch is located on <br />the left (south) bank of the Snake River in the NW 1/4 SE 1/4 of Section 22, Township 5 <br />South, Range 77 West, 6th P.M.; <br />(b) Soda Creek Ditch, decreed for 2.72 c.f.s. with a July l, 1900 appropriation date and a <br />March 2, 1952 adjudication date. The originally decreed headgate of the Soda Creek <br />Ditch is located on the right (east) bank of the Soda Creek at a point whence the South <br />quarter corner of Section 27, Township 5 South, Range 77 West, 6th P.M., bears South <br />10° 15' East a distance of 940 feet; <br />(c) Phillips Ditch, decreed for 4.00 c.f.s. with a June l, 1904 appropriation date and a March <br />2, 1910 adjudication date. The originally decreed headgate of the Phillips Ditch is <br />located on the left (west) bank of the Keystone Creek in the SW 1/4 SW 1/4 of Section <br />14, Township 5 South, Range 77 West, 6th P.M.; <br />� (d) Rice Ditch - Riley Enlargement, decreed for 10.00 c.f.s. with a July 5, 1914 appropriation <br />date and an October 26, 1937 adjudication date. The originally decreed headgate of the <br />Riley Enlargement is located on the left (south) bank of the Snake River at a point <br />� whence the SW corner of Section 22, Township 5 South, Range 77 West, 6th P.M., beaxs <br />South 54°46' West a distance of 3845 feet; and <br />� <br />� <br />� <br />� <br />� <br />(e) Rice Ditch - Rice Enlargement, decreed for 10.00 c.f.s. with a July 5, 1914 appropriation <br />date and a March 10, 1952 adjudication date. The originally decreed headgate of the <br />Rice Enlargement is the same as the Rice Ditch - Riley Enlargement, <br />as said water rights were changed by the Water Court in the Case Nos. W-217 and W- <br />2110, (all the foregoing hereinafter called the "consumptive water right"), <br />together with six acre-feet per year of the 25 acre-feet per year of augmentation water <br />to be released to the Blue River from Dillon Reservoir (the "Dillon Storage Water") <br />pursuant to paragraph 6(b) of the Agreement dated September 18, 1985 between the <br />City and County of Denver acting by and through its Board of Water Commissioners <br />and the Board of County Commissioners of Summit County, Colorado ("the County"), <br />and the Agreement dated November 8, 1990 between the City and County of <br />13 <br />� <br />
