� <br />� <br />Water Rights and Property <br />Under the settlement with BMDC, the District would acquire clear title to the following: <br />Description of Propertv <br />� The real property, together with improvements, if any, and any personal property <br />� situate, lying and being in the County of Summit, and State of Colorado, described as <br />follows: <br />� (a) The Water Rights described in Exhibit A attached hereto, together with <br />any and all other water and water rights appurtenant to the Swan's Nest <br />Metropolitan District, or that have been, are, or may in the future be, used within <br />� the original service area of the Swan's Nest Metropolitan District including, <br />without limitation, the Tiger Run RV Park; and, without limiting the foregoing, said <br />water and water rights shall include the "Water Rights" described in that certain <br />� Master Lease between Breckenridge Meadows Development Company, L.L.C. <br />as "Master Lessor," and Swan's Nest Metropolitan District as "Master Lessee" <br />dated March 11, 1997 and recorded on March 28, 1997 in the Office of the <br />j Summit County Recorder at Reception No. 536032; and <br />(b) All improvements and infrastructure (e.g,, wells, pumps, pipes, storage <br />� tanks, and appurtenances thereto) that have been, are, or may in the future be, <br />used to withdraw, treat, and supply water for/to customers within the original <br />service area of the Swan's Nest Metropolitan District including, without limitation, <br />� the Tiger Run RV Park; and without limiting the foregoing, said improvements <br />and infrastructure shall include the "Real Property" described in that certain <br />Master Lease between Breckenridge Meadows Development Company, L.L.C. <br />� as "Master Lessor," and Swan's Nest Metropolitan District as "Master Lessee" <br />dated March 11, 1997 and recorded on March 28, 1997 in the Office of the <br />Summit County Recorder at Reception No. 536032. <br />� <br />� <br />� <br />� <br /> �� <br />12 <br />� <br />
