, <br />' Denver acting by and through its Board of Water Commissioners and Swan's <br />Nest Metropolitan District (°'the District'), <br />' <br />together with any and all rights (decreed or otherwise) appurtenant to the foregoing <br />' and all rights (decreed or otherwise) held by the Grantor under decrees of the Water <br />Court in Case Nos. 84CW716 and 87CW216. <br />The consumptive water right and the Dillon Storage Water were acquired by lSwan's <br />Nest Metropolitan DistrictJ from Vidler Tunnel Water Co. by General Warranty Deed <br />recorded in Summit County on September 12, 1987 under Reception No. 342034 and <br />by Quitclaim Deed �and Assignment] recorded in Summit County on September 12, <br />1987 under Reception No. 342033. <br />* All but the bold italicized portion of the description comes from the Quitclaim Deed and <br />Assignment from Swan's Nest Metropolitan District to Southwest Federal Savings <br />Association dated August 15, 1992 and recorded on September 10, 1992 in the Office <br />of the Summit County Recorder at Reception No. 428266. <br />District Offer to Greg Timm is included in Exhibit F <br />Adequacy of Rights to Meet Existing District Need <br />The subject water rights are more than adequate to meet SNMD needs both now and in <br />the future. We are 98% maximum build out and the 6 SFEs reserved for Parcel A will <br />most likely never occur. The 3 SFEs in Swan River Ranch will occur but the 3 in Swan's <br />Nest are also unlikely. The subject rights have about 3.0 acre feet of consumptive use <br />water that is still available for the District. This occurred because density in old Parcel <br />G, which had been in the district, had 28 SFE for employee housing. That parcel was <br />given to the County for open space allocation. It is no longer in the district. The currently <br />available consumptive use water will likely be used for additional irrigation within the <br />District or, depending on negotiations with Tiger Run, for irrigation use in the RV Park. <br />Water Rights Appraisal <br />The water rights described above were analyzed to estimate their value and confirm the <br />� basics for settlement. The value of a water right can be examined using various <br />approaches, including alternative cost method, comparable sale method and others. <br />' Generally, the value of a water right depends primarily on the historic consumptive use <br />of the water right, which is that amount of water that has been beneficially used and can <br />be changed to other uses. Many other factors affect water right va�ues, such as the <br />' location, reliability (seniority), season of use, market conditions (eg. Availability of other <br />sources), and proposed future use of the right. <br />� <br />iC� <br /> �I' <br />
