City of Durango <br />Case No. 06CW9 <br />Page 2 <br />opposers' experts, including the necessity for any additional terms and conditions proposed <br />by opposers' experts. <br />Mr. Shipley and Mr. Lacy will be compensated at their regular hourly rate for their testimony <br />in this matter. Mr. Shipley's and Mr. Lacy's qualifications, publications within the <br />preceding 10 years, and expert testimony within the preceding four years are as stated on <br />their resumes, copies of which are attached to these disclosures. <br />2. Gary B. Thompson, P.E., W. W. Wheeler and Associates, Inc., 3700 South Inca Street, <br />Englewood, Colorado 80110, (303) 761 -4130. Mr. Thompson has been retained by the City <br />to provide expert testimony concerning all water rights and water resources issues associated <br />with the application in this case including, but not limited to, hydrology ofthe Animas River <br />and related matters. Mr. Thompson's opinions, the bases and reasons therefor, and the data <br />or other information considered by him in forming his opinions are described in his report <br />entitled "City of Durango Boating Park Study," dated February 2006, revised September <br />2006 ( "September 2006 Report"), a copy of which is attached. The documents which form <br />the bases for Mr. Thompson's opinions and the exhibits to be used as a summary of or <br />support for his opinions are identified in, referenced in and /or attached to the September <br />2006 Report and/or in the Rule 26(a)(1) disclosures of the City and opposers. Mr. <br />Thompson may also testify concerning the identity and location of water rights on the <br />Animas River and its tributaries, the location and use of water rights owned and used by <br />opposers, and administration on the Animas River and its tributaries. Mr. Thompson may <br />also provide expert testimony at trial as necessary in response to or in explanation of expert <br />opinions and/or testimony disclosed prior to or given at trial by opposers' experts, including <br />the necessity for any additional terms and conditions proposed by opposers' experts. <br />Mr. Thompson will be compensated at his regular hourly rate for his testimony in this matter. <br />Mr. Thompson's qualifications, publications within the preceding 10 years, and expert <br />testimony within the preceding four years are as stated on his resume, a copy of which is <br />attached to these disclosures. <br />3. Andrew Klotz and Gabe Preston, RPI Consulting, Inc., 2012 Glen Isle Avenue, Durango, <br />Colorado 81301, (970) 382 -9153 or (970) 382 -9886. Mr. Klotz and Mr. Preston have been <br />retained by the City to provide expert testimony concerning various matters including, but <br />not limited to, the economic impacts associated with boating on the Animas River and <br />potential future uses of water from the Animas River, both upstream and downstream of the <br />Durango Boating Park. Mr. Klotz's and Mr. Preston's opinions, the bases and reasons <br />therefor, and the data or other information considered by them in forming their opinions are <br />described in their June 2006 report entitled "Economic Impacts of Whitewater Recreation," <br />
