Box 1440 <br />Boulder, CO 80306 -1440 <br />(303) 443 -8782 <br />RULE 26(a)(2) DISCLOSURES OF APPLICANT, CITY OF DURANGO <br />Applicant, City of Durango (the "City"), by and through its attorneys, Moses, <br />Wittemyer, Harrison and Woodruff, P.C., submits the following disclosures pursuant to Rule 11 of <br />the Uniform Local Rules for all State Water Court Divisions and Rule 26(a)(2), C.R.C.P.: <br />Identity of persons who may present evidence at trial, pursuant to Rules 702, 703 or 705 of the <br />Colorado Rules of Evidence: <br />1. Scott Shipley, P.E., and/or Gary M. Lacy, P.E., Recreation Engineering and Planning, <br />485 Arapahoe Avenue, Boulder, Colorado 80302, (303) 545 -5880. Mr. Shipley and Mr. <br />Lacy have been retained by the City to design the Durango Boating Park and to provide <br />expert testimony at trial concerning all matters related to the design, use, operation and <br />functionality of the Durango Boating Park. Mr. Shipley's and Mr. Lacy's opinions, the <br />bases and reasons therefor, and the data or other information considered by them in forming <br />their opinions are described in their two reports dated September 1 and September 8, 2006. <br />Copies of these two reports on CD have been mailed to all opposers because the reports <br />exceed. CourtLink filing size limitations. The documents which form the bases for Mr. <br />Shipley's and Mr. Lacy's opinions and the exhibits to be used as a summary of or support <br />for their opinions are identified in, referenced in and/or attached to the September 1 and 8, <br />2006 reports and/or in the Rule 26(a)(1) disclosures of the City and opposers. Mr. Shipley <br />and Mr. Lacy may also provide expert testimony at trial as necessary in response to or in <br />explanation of expert opinions and/or testimony disclosed prior to or given at trial by <br />
