City of Durango <br />Case No. 06C W9 <br />Page 3 <br />which was previously provided to opposers, and their September 2006 reports entitled <br />"Rafting and Water Flows: A Survey & Analysis of Lower Animas Commercial <br />Operations" and "Animas Basin Future Residential Development and Water Demand <br />Study," copies of which are attached hereto. The documents which form the bases for Mr. <br />Klotz's and Mr. Preston's opinions and the exhibits to be used as a summary of or support <br />for their opinions are identified in, referenced in and/or attached to. the June 2006 report and <br />the September 2006 reports and /or the Rule 26(a)(1) disclosures of the City and opposers. <br />Mr. Klotz and Mr. Preston may also provide expert testimony at trial as necessary in <br />response to or in explanation of expert opinions and /or testimony disclosed prior to or given <br />at trial by opposers' experts, including the necessity for any additional terms and conditions <br />proposed by opposers' experts: <br />Mr. Klotz and Mr. Preston will be compensated at their regular hourly rate for their <br />testimony in this matter. Mr. Klotz's and Mr. Preston's qualifications, publications within <br />the preceding 10 years, and expert testimony within the preceding four years are as stated <br />on their resumes, copies of which are attached to these disclosures. <br />Paper copies of the above- referenced reports are available to opposers upon request to the <br />undersigned.
