' <br />C_J <br />� <br />' <br />' <br />� <br />' <br />' <br />' <br />' <br />' <br />, <br />' <br />, <br />� <br />� <br />� <br />' <br />� <br />' <br />�' <br />able to negotiate with SECWCD for an additional 135 acre-feet of excess return flows at $6.50 per acre- <br />foot and an allocation from the SECWCD's emergency fund of 1,000 acre-feet at $8.25 per acre-foot. <br />Cherokee Metropolitan District <br />AGUA secured a 2002 Plan year contract for 1,550 acre-feet of reusable municipal return flows at a rate <br />of $11.00 per acre-foot from the Cherokee Metropolitan District for replacement of depletions on <br />Fountain Creek, with excess credits to be used on the Arkansas River. The reusable return flows are <br />generated following municipal use of non-tributary ground water and are provided to AGUA according <br />to a pre-determined monthly schedule. Of the total amount, 190 acre-feet were obtained for the use of <br />MAGUA with the remaining 1,360 acre-feet assigned for use by AGUA. <br />Cherokee discharges to the East Fork of Sand Creek approximately 5.4 miles upstream of Fountain <br />Creek. The State requires that a 10 percent transit loss be charged from the Cherokee Wastewater <br />Treatment Plant to Fountain Creek and an additional7 percent transit loss charged from Sand Creek to <br />the confluence of Fountain Creek and the Arkansas River. Thus, of the 190 acre-feet of replacement <br />credit assigned to MAGUA, only 171 acre-feet were available for replacement credit on Fountain Creek. <br />Similarly, of the 1,360 acre-feet assigned for use by AGUA, only 1,129 acre-feet were available for <br />replacement on the Arkansas River. <br />Other Replacement Sources <br />As previously mentioned, AGUA contracts for small amounts of replacement water to augment <br />depletions on various tributaries. During 2002, AGUA had agreements with Colorado City Metropolitan <br />District for 6 acre-feet at $92 per acre-foot and Manitou Springs Sparklers for 2 acre-feet at $100 per <br />acre-foot. AGUA also spent most of the year attempting to secure additional replacement sources in an <br />attempt to provide additional pumping to its members. AGUA was able to purchase 450 acre-feet from <br />the Las Animas Consolidated Canal Company at $25 per acre-foot and negotiated with Colorado Springs <br />Utilities for 1,998 acre-feet of municipal return flows they were unable to exchange into storage at $18 <br />per acre-foot. <br />As the 2002 plan year progressed, AGUA sought to negotiate contracts for additional replacement water. <br />In August AGUA purchased 450 acre-feet of Article III water from the Las Animas Consolidated Canal <br />Company at $25 per acre-foot. In September AGUA signed a contract with Colorado Springs Utilities <br />AGUA - 2003 Feasibility Study - 11 - August 15, 2003 <br />
