HB 06 -1337 CONCERNING PENALTIES LEVIED AGAINST A PERSON WHO VIOLATES <br />WATER QUALITY CONTROL PROVISIONS. <br />Sponsors: Butcher, Entz <br />Summary: Increases maximum discretionary fines for water quality violations from $10,000 to <br />$25,000 per day per violation. Creates a fund from fines paid for communities impacted by the <br />violations. <br />Analysis: This is principally a Pueblo representative's dig at Colorado Springs for Springs' repeated <br />wastewater spills down Fountain Creek. I don't believe the West Slope or the River District has a dog in <br />this fight. I do not believe it will pass. <br />Status: Passed House Agriculture Committee. To Appropriations. <br />CRWCD Position: Monitor <br />CWC Position: Oppose <br />HB 06 -1352 CONCERNING AN EXPANSION OF WATER JUDGES' JURISDICTION TO <br />• ADDRESS THE EFFECTS OF A WATER RIGHT ADJUDICATION ON WATER QUALITY. <br />Sponsor: McFadyen <br />Summary: This would allow a water court to consider water quality impacts and require mitigation for <br />change of use cases greater than 1000 acre feet. The Water Quality Control Commission's standards are <br />presumed protective (i.e., if the applicant meets the WQCC's standards for water quality, then there is <br />no impact). <br />Analysis: This bill is relatively innocuous to the west slope. With the 1000AF threshold this bill is <br />unlikely to affect intra -west slope change cases. It may, however, allow us to raise water quality <br />concerns with certain transmountain transfers (e.g., Shoshone). Someday the water community will <br />have to address a tighter relationship between water quantity and quality.
