HB 06 -1378 CONCERNING THE ALLOCATION OFSEVERANCE TAX PROCEEDS FOR . <br />LAND CONSERVATION PURPOSES. <br />Sponsor. Plant <br />Summary: Creates the land conservation fund. Appropriates $25M annually from the Department of <br />Local Affairs and Department of Natural Resources' severance tax accounts to fund the new program. <br />Authorizes the state board of the Great Outdoors Colorado trust fund to use the moneys in the fund to <br />award competitive grants to counties, municipalities, other political subdivisions, and nonprofit land <br />conservation organizations to acquire fee interests or land conservation easements. <br />Analysis: Creates a new state program whose purposes are largely duplicative with the Great <br />Outdoors Colorado (GOCO) program. Reduces available funds for Department of Local Affairs' <br />energy impact grants. Also takes $12.5M off the top of DNR's severance tax operational account, <br />thereby threatening viability of existing DNR programs, including staffing of the CWCB. <br />Status: Postponed Indefinitely 312112006 (House Local Affairs, 5 -6). <br />CRWCD Position: Oppose <br />HOUSE CONCURRENT RESOLUTIONS • <br />HCR 06 -1001 CONCERNING THE TAKING OF PRIVATE PROPERTY. <br />Sponsor: White/Tochtron <br />Summary: Restates that private property shall not be taken or damaged for a public or private use, <br />under applicable sections of the state constitution without just compensation. In order to exercise the <br />power of eminent domain a condemner must establish by clear and convincing evidence that the <br />condemnation of the property is for a public use. <br />Status: Passed State, Veterans & Military Affairs Committee.
