The motion carried. <br />3. LEGAL MATTERS <br />3a. RECREATIONAL IN- CHANNEL DIVERSION APPLICATION <br />Cindy Covell said that Jim Slattery has provided information for the <br />board's consideration regarding possible flows for the District's proposed <br />recreational in- channel diversion water right. She added that she will <br />develop a Memorandum of Agreement (MOA) with Gunnison County. <br />The County has requested a joint meeting at which the MOA could be <br />finalized and both boards can discuss the application. Ms. Covell said <br />that the City of Pueblo has filed for an RICD and has an agreement with <br />the CWCB to extend the time that the CWCB has to act on the <br />application. <br />Mark Schumacher asked when the board will discuss what the flow <br />amounts will be, and when there will be an opportunity for public input. <br />Greg Peterson said that this will be discussed at the joint meeting with <br />the County, during the week of February 12. <br />Mr. Schumacher indicated that he would like to see the flows broken <br />down on a fifteen -day increment, and he asked if there is some more <br />engineering data that will be released. He said that there are no board <br />members who work in the recreation industry, yet fifty percent of the <br />area's income comes from recreation. <br />Greg Peterson said that a water right that gives future certainty to park's <br />viability can be arrived at. He added that the board needs to consider all <br />the future uses and what the impact on those would be. <br />Ken Spann moved that if information is readily available from Jim <br />Slattery on historical flow data on a 15 -day timestep, to match the <br />charts passed out at the November 15 special board meeting, that <br />that information be made immediately available. Bill Trampe <br />seconded the motion. The motion carried. <br />Butch Clark said that he agreed with Mr. Schumacher that it is <br />appropriate to involve the public in the discussion. He added that the <br />information the board discussed giving to Mark is available on the <br />internet from the USGS. He urged the board not to make a blind <br />decision on the flows and recommended asking the recreational boaters <br />for help. <br />
