Gerald Lain, Gunnison River Retirement Community director and homeowner in <br />the area, said that he is concerned about potential flooding. He asked who <br />would be liable for flooding caused by the park's structures. He said that he feels <br />that the contemplated location is not a good choice, that either on the Taylor <br />River or closer to Blue Mesa on federal land would be a better choice. He said <br />that as GRRC president he strongly opposes it and added that it would also <br />devalue local property. He thanked the board for having a public hearing on the <br />subject. <br />Bob Willey, former president of the Gunnison River Retirement Community said <br />that he seconded Mr. Lain's statements and that he is particularly worried about <br />the possibility of ice dams forming during spring melt and ice break up. He said <br />he feels this will impact insurance and property values. <br />Butch Clark recommended publication 98 -14, a special report on nonstructural <br />ice control, and publication 111102 -1612 1982. <br />Scottie Willey, speaking for the West Gunnison Sanitation District, said that the <br />District is very much concerned about icing and flooding, and she reminded the <br />board that in the early 1980s the nursing home had to be evacuated due to <br />flooding. She recommended that a different location for the park be considered <br />in order to avoid evacuation, and to avoid flood waters covering manholes. <br />3b. PRESENTATION OF FLOW OPTI <br />The manager said that the board's previously stated intention was to file on a <br />meaningful water right by March 1, 2002, and to comply with the applicable <br />statutory requirements as set forth in SB -216. SB -216 states that recreational in- <br />channel diversion water rights should be the minimum amount needed to provide <br />a reasonable recreation experience. The board has been working with Gunnison <br />County to finalize a Memorandum of Agreement and get input on the flow <br />options. <br />3c. PUBLIC INPUT <br />Greg Peterson said that the graphs presenting flow options were released tonight <br />as public information. He invited public comment on the potential flow scenarios <br />represented on the graphs. <br />Jack Nichols thanked the UGRWCD and the County for considering the <br />Whitewater Park. He said that the economic impact of such a park would be <br />great. He said that the question of what is a meaningful flow needs to be <br />considered, and that somewhere between option 1 and option 2 makes the most <br />sense to him. He also suggested considering adding some flexibility into the <br />system to allow for higher flows for special events. He said that icing is a big <br />concern, but it's a design concern, not a flow quantity concern. Don Cardin <br />
