Board President Greg Peterson called the meeting to order at 5:12 p.m. <br />2. EXECUTIVE SESSION <br />Board attorney John McClow recommended that the board discuss matters <br />pertaining to the filing of a water right in conjunction with the proposed <br />Whitewater Park in executive session under §24- 6- 402(4)(a), (d), and (e) and <br />that this constitutes attorney - client privileged discussion. <br />Dennis Steckel moved and Bob Irby seconded to adjourn into executive <br />session to discuss matters relating to the filing of a water right in <br />conjunction with the proposed Whitewater Park in executive session under <br />§24- 6- 402(4)(a), (d), and (e). The motion carried. <br />Board President Greg Peterson reconvened the regular session. <br />The board took no action as a result of the executive session. <br />3. PUBLIC DISCUSSION OF WATER RIGHT APPLICATION <br />3a. APPLICATION STATUS <br />The manager said that the Whitewater Park would be a joint project of County of <br />Gunnison and the Upper Gunnison District. The water right would belong to the <br />District and the County would be responsible for the park's construction, <br />operation, and maintenance. She said that Gary Lacy, the park's design <br />engineer, will be here on February 25, 2002 at 6:00 p.m. and there will be an <br />opportunity for members of the public to discuss the design and potential impacts <br />of the proposed structures with him. <br />Butch Clark said that the airport management plan could affect the Whitewater <br />Park and he suggested further exploration. <br />Lee Spann read from a letter he submitted to the board: "The Kelmel -Owens #1 <br />Ditch diversion (74 cfs) is out of the West Branch just below the highway bridge. <br />Historically, we have relied on a substantial flow at this point so some water <br />could be bypassed to maintain the integrity of the West Branch. Since the West <br />Branch divides off the Main Stem, some one -half mile farther up and above the <br />proposed White Water Park, I would request that a stipulation be made a part of <br />the proposed decree stating that the historical flow of the West Branch (85 cfs <br />minimum) would not be reduced, stopped or diverted to fill this decree." <br />Greg Peterson stated that it is probably possible to meet a flow of 85 cfs, and <br />that he does not envision the UGRWCD doing anything to impact that. <br />
