It recognizes the small rights that a few of them filed in 2002, <br />and agrees that the Whitewater Park will be operated junior to those rights and <br />acknowledges that if the homeowners file a change for the Island Acres Ditch, <br />the District will not oppose that change providing it's consistent with ordinary <br />indoor and outdoor uses associated with rural residential lots located along the <br />West Branch. The homeowners agreed to drop their opposition in exchange for <br />these conditions. <br />Don Cardin moved to accept the stipulation with Gerald E. Bullock, et al. <br />(the West Branch homeowners). Jim Cochran seconded the motion. The <br />motion carried, with Ken Spann abstaining due to being recused from <br />discussion of the RICD application. <br />4. LEGISLATIVE COMMITTEE UPDATE <br />John McClow said that the CWC State Affairs Committee discussed HB 1146 at <br />its last meeting. This bill would add water quality criteria to an application for a <br />change of water right. He said that he submitted exemption language and it is <br />now incorporated in the draft bill. On the water right loan bill, Senator Isgar <br />agreed to accept a rewrite by the CWC subcommittee. Steve Glazer said that <br />SB 087 passed out of committee yesterday with one major amendment. Senator <br />Isgar increased the trigger for compliance to the requirements in the bill from <br />2,000 to 6,000 acre feet, with the intent of exempting the cities in his district from <br />compliance. The manager said that she testified last week at the House <br />Agricultural Committee on HB 1090. There is a vote to lay it over another week. <br />She said that Representative Carl Miller is trying to make it a requirement that <br />utilities develop wells to meet peak demand and not turn to West Slope sources <br />for emergencies. <br />S. WATER SUPPLY IMPROVEMENT GRANT PROGRAM DISCUSSION <br />The board discussed the proposed policy for consideration of grant funding <br />requests. <br />The consensus of the board was for the manager to make changes to the <br />proposed policy for the board's consideration at its February 24, 2003 board <br />meeting. <br />6. COLORADO 58 WATER PRINCIPLES DISCUSSION <br />Greg Peterson noted that Dennis Steckel was unable to attend this meeting but <br />he submitted a letter to the board dated February 13, 2003 on this subject <br />The manager said that the Colorado 58/64 water principles have gotten worse as <br />a result of redrafting.
