GUNNISON COUNTY BOARD OF COMMISSIONERS Page 15 of 17 <br />copies of related easement agreements. <br />27) The easement for the City of Gunnison's irrigation ditch and its required setbacks are <br />required to be shown on the Final Plat. <br />28) Language is to be added to the Protective Covenants indicating that the "island" is not to <br />be used by park residents. <br />29) Language is to be included within the protective covenants relative to recommendations of <br />the Colorado State Forest Service for maintenance of lawns and common ground areas, <br />stacking of fire wood, and inclusion of signs identifying lot owner and address, identifying <br />that provision and maintenance of those elements are a responsibility to be overseen by <br />the homeowners' association. <br />30) Fire flow information, relative to Section 5 -305: D. 6., and Table 5 -1. of the Revised Land <br />Use Resolution, and written affirmation of its adequacy by the Gunnison Fire Marshall. <br />31) The design requirements recommended by the Gunnison Fire Marshal within a letter <br />dated January 29, 2002 including features of installation of dry hydrants, provision of <br />specific connections, and construction and maintenance of all- weather access to hydrants, <br />are in the best interest of public health, safety and welfare, and such design requirements <br />shall be required to be included within the Final Plan, which shall be subject to review and <br />approval of the Fire Marshal prior to submittal. <br />32) Language is required to be added to Section 17.2.2 of the Protective Covenants to require <br />that disposal of solid waste is the responsibility of the homeowners' association, which will <br />employ a commercial hauler to collect refuse and dispose of it in the appropriately <br />permitted Landfill. <br />33) A central storage area and two trash collection areas have been proposed; language is <br />required to be included in the Protective Covenants that imposes maintenance of those <br />areas on the homeowners' association. The trash collection areas shall be fenced with a <br />solid wood fence in order to mitigate visual impacts. <br />34) Language requiring an onsite caretaker and other enforcement is required to be included <br />in the protective covenants. <br />35) Signed copies of agreement by all irrigation ditch owners within the Whipp Ditch, <br />approving the relocation of the ditch as delineated on the Final Plat submitted as part of <br />the Final Plan. The applicant proposes to relocate the Whipp irrigation ditch, which <br />crosses the northern portion of this parcel. <br />36) The final landscaping design plan within the development, including provision for <br />replacement of existing vegetation along the Guerrieri drainage ditch for any reason the <br />vegetation is significantly decreased. The specific kinds of vegetation (heights and types of <br />trees and bushes) within it are required to be included within the final landscaping design <br />plan, and the width of the buffer shown on the Final Plat. The plan shall detail the means <br />for ensuring maintenance of existing vegetation, and planting and maintaining new <br />vegetation. <br />37) Language is required to be added to the Protective Covenants requiring individual <br />homeowners to landscape their own properties, and describing the required vegetation <br />and indicating that maintenance of that vegetation is also required. <br />38) Language is required to be added to the Protective Covenants forbidding the discharge of <br />firearms within the park and subdivision. <br />39) The final water supply plan, including the estimated related demand for water to include <br />information required by the Natural Resources Conservation Service per Section 5 <br />http : / /www.co.gunnison.co.usBOCC /minutes /20030304nm.html 6/6/2003 <br />
