GUNNISON COUNTY BOARD OF COMMISSIONERS Page 14 of 17 <br />facts, subject to its compliance with current regulations, and its impact to the County. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Gunnison County, <br />Colorado, that the Preliminary Plan application for North Cottonwood Park, Bonanza Properties, LLC, LUC 2000- <br />57 be approved with the following conditions: <br />1. The applicant is required to submit as part of the Final Plan submittal a draft Development <br />Improvement Agreement (DIA), addressing the amenities defined in the following plans, as <br />prepared by Buckhorn Geotech, dated February 22, 2002, or as appropriately updated to reflect <br />changes in plan design and layout approved during this Preliminary Plan review <br />a) Site Layout and Grading Plan (2 of 2) <br />12) Site Utilities Plan (1 of 2) <br />13) Site Utilities Plan (2 of 2) <br />14) Interior Road Profile and Typical Sections <br />15) Water Facilities and Treatment Building <br />16) Water Tank, Well Diagram, Details and Schematics <br />17) Water System Details <br />18) Sanitary Sewer System Details <br />19) Drainage and Miscellaneous Details <br />20) Intersection Details <br />2. Other items to be addressed within the DIA and for which estimated costs are to be provided, shall <br />include the following, or these elements as appropriately updated to reflect changes in plan design <br />and layout approved during this Preliminary Plan review: <br />a) Landscaping as described within Landscape Detail, prepared by Furey Land Surveying, dated <br />September 3, 2002. <br />b)Construction of a three -rail dowel fence on the sides of the recreational area that border County <br />Road 11 and the subdivision interior road. <br />c) A pro -rata share of costs, based upon a quantifiable impact for which this development is directly <br />responsible for maintenance of County Road 11, which determinations are subject to <br />recommendation by the Gunnison County Public Works Department, and to the approval by <br />the Board. <br />3. The following shall be included as elements of the Final Plan submittal: <br />b)All documentation related to a decree from the Water Court, adjudicating water rights, and an <br />approved plan of water augmentation. <br />21) A copy of the new well permit for the existing well, as required by the Division of Water <br />Resources. <br />22) A copy of a written access agreement between the City and the applicant to allow the <br />applicant and subsequent homeowners within this subdivision to remove water from the <br />City of Gunnison ditch for irrigation. <br />23) Language shall be included in the protective covenants indicating no fences, sheds or <br />other structures shall be allowed to be located within the easement along the City's ditch. <br />24) Language shall be included in the protective covenants and on the Final Plat requiring the <br />applicant to assure construction of a gate on the walkway across the subject property to <br />the City of Gunnison's diversion structure. <br />25) a school bus stop and mailboxes for subdivision residents will provided onsite; those <br />locations are required to be included on the Final Plat and are subject to approval by the <br />Board. <br />26) Delineation of easement locations allowing the construction and location of sewer lines <br />from the development property across adjacent properties to the main collection line, and <br />http : / /www.co.gunnison.co.us/BOCC /minutes /20030304nm.html 6/6/2003 <br />
