GUNNISON COUNTY BOARD OF COMMISSIONERS <br />Page 13 of 17 <br />Other items to be addressed within the DIA and for which estimated costs are to be provided by <br />contractors or appropriate equipment manufacturers, or other such experts, shall include: <br />a) Landscaping as described within Landscape Detail, prepared by Furey Land Surveying, dated <br />September 3, 2002. <br />b)Fencing on the sides of the recreational area that border County Road 11 and the subdivision <br />interior road. <br />c) A pro -rata share of costs, based upon a quantifiable impact for which this development is directly <br />responsible for maintenance of County Road 11, which determinations are subject to <br />recommendation by the Gunnison County Public Works Department, and to the approval by <br />the Board. <br />26. The Guerrieri Ditch, which was referenced throughout this Preliminary Plan review process as an <br />irrigation ditch has been verbally clarified by owner Richard Guerrieri to be a drainage ditch, and so <br />no easement for historical maintenance is required. <br />27. A portion of the project site has been delineated as being with the loo -year floodplain. Delineation <br />of the loo -year floodplain is required to be on the Final Plat, and the applicant is required to include <br />within deeds of all applicable properties that lie within the delineated floodplain language required <br />by Section 5 -203: F. 1., Warning and Disclaimer of Floodplain Hazards Affecting Use and <br />Occupancy of This Property. The applicant is required to sign such Warning as well, and submit it <br />as part of the Final Plan. <br />28. The Gunnison County Public Works Department has noted that because lots within the <br />development are currently shown as being in the floodplain, a Letter of Map Amendment must be <br />submitted to FEMA to more accurately define the floodplain boundary; such correction will affect <br />availability of service to the applicable lots via the North Interceptor Sewer line. <br />29. Language regarding Lighting restrictions cited within Section 5 -414: C. of the Resolution, as <br />amended is required to be included within the Protective Covenants submitted as part of Final Plan. <br />30. The applicant has indicated that language will be added to Section 17.2.2 of the Protective Covenants <br />to require that disposal of solid waste is the responsibility of the homeowners' association, which <br />will employ a commercial hauler to collect refuse and dispose of it in a appropriately permitted <br />landfill. That language does not exist in the submitted draft covenants. <br />31. The applicant has indicated that a caretaker will be onsite to manage the manufactured home park <br />and control pets within North Cottonwood Park; language requiring such an onsite caretaker is <br />required to be included in the protective covenants. <br />32. A central storage area and trash collection area have been proposed; language is required to be <br />included in the Protective Covenants that imposes maintenance of those areas on the homeowners' <br />association. In this Preliminary Plan review, the Planning Commission has agreed that those areas <br />should be fenced with a solid wood fence in order to mitigate visual impacts. <br />33• Approval is limited to activities described within the "Project Description" of this application, and as <br />depicted on the site plan as submitted. Expansion or change of this use will require either an <br />application for amendment of this permit, or submittal of an application for a new permit, in <br />compliance with applicable requirements of the former Land Use Resolution. <br />34• This review and decision incorporates, but is not limited to, all the documentation submitted to the <br />County and included within the Planning Office file relative to this application; including all <br />exhibits, references and documents as included therein. <br />35• Review of this application has considered the impact of this proposed use in the context of <br />cumulative impacts to the environment and the community in the context of its compliance with <br />County land use policies. Approval of this use is based upon the facts presented and implies no <br />approval of a similar use in a different location and with different impacts on the environment and <br />community.
