• • • FVA REOPERATIONS MOA B. Enterprise responsibilities: • • 1. The Enterprise shall work with•Reclamation to establish whether authority • exists under existing Federal law for the Reoperations plan and for entry into Reoperation Contracts with Reoperation Participants. Meanwhile, the • Enterprise shall undertake efforts, in cooperation with the FVA • • Participants and any other Reoperation Participants, to enact appropriate legislation to provide or confirm the necessary authority. 2. • The Enterprise shall provide to the FVA all estimates and accounting reasonably necessary to facilitate the payments referred to in Part V of this MOA, and shall provide to the FVA.an annual report documenting all costs and expenditures, and summarizing progress to date and anticipated future work. • 0 3. The Enterprise will deposit funds received from the FVA in an interest- • bearing account, for use to pay implementation and development costs of Reoperations as such costs are incurred. • 4: The Enterprise shall be responsible for administering the Winter Water Spill Credit as set forth in the Implementation Committee Report. • • 5. The Enterprise shall be responsible for facilitating the definition, . implementation, and administration of the flow management program as • outlined in the.Implementation Committee Report, with the advice of the Storage Implementation Committee. Similarly, the Enterprise in cooperation with the USGS shall be responsible for facilitating the • • definition, implementation and administration of the long -term water quality. monitoring program as outlined in the Implementation Committee Report, with the advice of the Storage Implementation Committee. • 6. The Enterprise's undertaking and fulfillment of its responsibilities described above is dependent upon its receipt of the financial contributions of the FVA and any other Reoperation Participants as set forth in this MOA. • • • • -9-
