• <br /> • <br /> FVA REOPERATIONS NIOA <br /> • <br /> C. Enterprise and Reoperation Participants' ioint responsibilities: Implementation <br /> Committee participation: <br /> • I. The Storage Implementation Committee is a successor to the Storage <br /> Study Committee, which has acted as an advisory committee to the Needs <br /> - Assessment Enterprise. Each Reoperation Participant (including each <br /> Member Participant) shall have one representative on the Storage <br /> • <br /> Implementation Committee, which shall act as an advisory committee to <br /> the Enterprise regarding implementation and development of Reoperations <br /> • <br /> and Enlargements. Membership in the Storage Implementation <br /> .Committee may or may not be limited to representatives of the Enterprise <br /> and the Reoperation Participants and participants in the Enlargements, at <br /> the discretion of the Enterprise Board. The Implementation Committee <br /> may .form a Reoperations Subcommittee consisting of representatives of . <br /> the Enterprise and Reoperation Participants, to provide guidance specific <br /> • <br /> • <br /> • • <br /> to implementation of Reoperations. <br /> 2. Some of the municipal beneficiaries of the Fryingpan- Arkansas Project are. <br /> not Reoperation Participants as defined in this MOA. The Enterprise and <br /> FVA Participants shall oppose the execution of Reoperation Contracts <br /> • <br /> prior to December 31, 2021, with any entity not participating in <br /> • <br /> implementation costs of Reoperations consistent with this MOA, unless <br /> and until such entity has entered into an agreement with the Enterprise to <br /> fully reimburse its proportionate share of the Enterprise's implementation <br /> and development costs for Reoperations consistent with this MOA, to the <br /> Enterprise.and/or the Reoperation Participants, as appropriate. <br /> • <br /> • <br /> V. Payment Requirements <br /> • <br /> A. Implementation costs <br /> 1. During the implementation phase (prior to execution of the • <br /> Reoperation Contracts), the FVA shall make payments to the Enterprise on <br /> a quarterly basis in an amount based on the FVA's share (as defined in <br /> �j IV.A.3 above) of the estimated costs of work to be performed by <br /> Reclamation and the Enterprise in the upcoming quarter. <br /> • <br /> 2. The FVA shall be credited for any advance payments made but not <br /> expended in the previous quarter, and shall be charged for its share of any <br /> expenditures in excess of advance payments in the previous quarter. <br /> • <br /> • <br /> • <br /> -10- <br />
