ENLARGEMENTS MOA
PUEBLO BOARD OF WATERWORKS
for storage in Pueblo Reservoir or its enlarged capacity. Water stored by
Participant in the enlarged capacity of Turquoise Reservoir must be legally
and physically available under decrees held by Participant for storage in
Turquoise Reservoir or its enlarged capacity. Storage in the Enlargements
shall be subject to any limitations established by the Enlargements
Authorizing Legislation and the Enterprise's master storage contract with
Reclamation, such contract to be subject to consultation with Participants.
Participant shall be solely responsible for any change of water rights
proceeding or other adjudication that may be necessary in order to store its
own non - Project water in one or more of the enlarged Fry-Ark Reservoirs.
B. Enterprise responsibilities:
1. The Enterprise shall undertake efforts, in cooperation with the
Enlargements Participants, to enact appropriate legislation to provide the
necessary authority for necessary studies leading to, and for construction
of, the Enlargements.
