3. Notice and Jurisdiction: Proper notice of the Application was given in the manner provided
bylaw, and the time for filing Statements of Opposition to this Application has expired. The
Court has jurisdiction over the subject matter of the Application and over all parties who
have standing to appear whether or not they have appeared.

A. On February 26, 2003, Tri-State Generation and Transmission Association, Inc.
(hereinafter, "Tri-State") filed a timely Statement of Opposition.
B. The River District and Tri-State entered into a Stipulation and Agreement on May 4,
2005, by which Tri -State consents to the entry of this decree. The Stipulation and
Agreement is incorporated herein by this reference.
5. Report and Summary of Consultation by the Division Engineer: The Water Court finds that
the River District has addressed the issues raised in the Division Engineer's Report and
Summary of C onsultation dated May 7, 2003.
