CA04016 <br />F. Old Dillon Reservoir was originally constructed in 1939 by the Town of Dillon <br />("Dillon") with a capacity of 46.14 acre feet. As part of Summit County's efforts to meet <br />the current and future water needs of its residents, Summit County obtained an eighty <br />percent (80%) interest in the Old Dillon Reservoir First Enlargement from Dillon as <br />evidenced by the Water Agreement dated August 24, 1992. Summit County and Dillon <br />adjudicated a water storage right for the Old Dillon Reservoir First Enlargement in the <br />amount of 150 acre feet and a plan of exchange to store up to 53.4 acre feet of Windy <br />Gap water in the Old Dillon Reservoir First Enlargement. The Town of Silverthorne <br />("Silverthorne") owns 11.87 acre feet of Valaer Ditch water rights that are decreed for <br />storage in the Old Dillon Reservoir First Enlaxgement. <br />G. Summit County, Dillon, and Silverthorne are interested in improving their water supplies <br />by better utilizing the water rights and interests they have in Old Dillon Reservoir and the <br />Old Dillon Reservoir First Enlargement. <br />H. Summit County and the River District agree that enlarging Old Dillon Reservoir would <br />benefit both the River Jistrict and Summit County and their respective constituents. <br />AGREEMENTS <br />Authori . This Agreement is authorized by and entered into pursuant to C.R.S. § 29-1- <br />201, et seq., and Section 2, Art. XI and Section 18, Art. VIV of the Colorado <br />Constitution. <br />2. Purpose. This Agreement is made in order to establish the mutual rights, duties, and <br />obligations of the River District and Summit County in connection with an evaluation of <br />alternatives to improve the utility of Old Dillon Reservoir, including a potential <br />enlargement, and implementation of the preferred alternative ("Project"). The Project <br />will be completed in three phases: (1) identification and evaluation of alternatives and <br />selection of a preferred alternative; (2) project design and permitting; and (3) <br />construction. The parties agree to revisit the terms of this Agreement, including but not <br />limited to the provisions regarding payment of invoices, upon completion of the first <br />phase of the Project and to amend this Agreement as necessary to facilitate the <br />implementation of the preferred alternative. <br />3. Work Orders. Specific tasks, costs, and expenses related to each phase of the Project will <br />be documented in Work Orders approved and signed by both parties and shall reference <br />this Agreement. All Work Orders made hereunder shall be subject to and governed by <br />the terms and conditions of this Agreement. Any amendment to any Work Order shall be <br />agreed to in writing by both parties.
