EXHIBIT A <br />CRWCD'S PREHEARING <br />STATEMENT <br />(SILVERTHORNE RICD) <br />CA04016 <br />INTERGOVERNMENTAL AGREEMENT <br />This Intergovernmental Agreement ("Agreement") is made by and between the Colorado <br />River Water Conservation District, acting by and through its Colorado River Water Projects <br />Enterprise ("River District") and the Board of County Commissioners of the County of Summit <br />("Summit County"). <br />RECITALS <br />A. The River District is a political subdivision of the State of Colorado created and existing <br />pursuant to its Organic Act, C.R.S. § 37-46-101, et seq., and other applicable Colorado <br />law. <br />B. Summit County is a political subdivision of the State of Colorado created and existing <br />pursuant to Section 1, Art. XIV of the Colorado Constitution, C.R.S. § 30-5-168, and <br />other applicable Colorado law. Summit County is included within the area that <br />comprises the River District. C.R.S. § 37-46-103. <br />C. C.R.S. § 29-1-201, et seq., and Section 2, Art. XI and Section 18, Art. VIV of the <br />Colorado Constitution authorize and encourage governmental entities to enter into <br />contracts with each other for the purpose of making the most effective and efficient use <br />of their powers and responsibilities through mutual cooperation. <br />D. Summit County and the River District each have the authority to construct, own, operate, <br />and maintain water storage facilities. <br />The River District is authorized by its Organic Act to "perform all acts and things <br />necessary or advisable to secure and insure an adequate supply of water, present <br />and future," for beneficial uses within the River District. C.R.S. § 37-46-107(c). <br />2. The River District owns and conducts a business engaged in water activities <br />pursuant to the Water Activity Enterprise Act, C.R.S. § 37-45.1-101, et seq., in <br />order to provide beneficial use of water within the District. <br />Summit County is authorized to construct, own, operate and maintain water <br />storage facilities pursuant to C.R.S. § 30-20-402. <br />E. The constituents of the River District and Summit County have mutual interests in the <br />development of water storage within the Blue River drainage basin.
