• <br />d. Effect on Flooding and Flood Control <br />The Silverthorne RICD will not affect flooding, flood control, or the 100-year <br />flood elevations in excess of that allowed by the Town of Silverthorne's <br />floodplain regulations and requirements. The Course will be designed to raise <br />the water surface profile of the 100-year flood less than 1.0 foot in order to <br />comply with the Town's regulations. <br />3. There will be adequate access for the RICD. <br />a. Nature and Extent of Access <br />Access to the Course will be achieved by the existing bike path located as <br />shown in Exhibits B and D. The bike path runs the entire length of the course <br />on the east side of the Blue River and will serve for both put-in and take-out <br />locations. In addition, the path will allow for easy access between the <br />upstream and downstream end of the course. Right-of-way for the bike path is <br />owned by the Town. <br />b. Ownership, leasehold, and other legal interests <br />? Parking for the Course is available in the parking lots as shown in Exhibits B <br />and D. These parking lots are owned by The Outlets at Silverthorne, and at <br />the present time there is a verbal authorization between the Town and The <br />Outlets to allow for parking for the Course. <br />c. Impediments to the Applicant obtaining access <br />The are no known impediments to the applicant obtaining access determined <br />necessary for the intended use. <br />4. The Silverthorne RICD will not injure the existing ISF in the proposed reach, or <br />ISF in other reaches of the Blue and Colorado Rivers. <br />a. The Nature and Extent of the ISF <br />The Colorado Water Conservation Board's in-stream flow right (decreed in <br />Case No. 5-87CW295) for this reach of the Blue River is 55, 52, and 50 cfs, <br />from the confluence with Straight Creek to the confluence of Willow Creek, <br />during the periods May 1 to July 31, August 1 to September 30, and October <br />to April 30, respectively. The requested RICD will help increase the <br />frequency and duration of the flows exceeding this decreed minimum in- <br />stream right during the May through September period. <br />•
