• e. Exchange opportunities within the State <br />Limited exchange capacity exists in the Blue River Reach in which the Course <br />will be located because: <br />All water rights upstream from the Course which are eligible for <br />protection from the Green Mountain Reservoir Historic Users' <br />Pool (HUP) have exchange rights from the HUP based on the <br />priority dates of their respective structures as decreed in Case No. <br />88CW382. These existing exchange rights are senior to the <br />priority date for Silverthorne RICD and will be unaffected by the <br />RICD. <br />• There are other senior rights of exchange decreed in this reach <br />(e.g., Case No. 95CW122 (Summit County Decree, see Exhibit M) <br />and Case No. 97CVV305 (Vidler Tunnel Plan for Augmentation, <br />see Exhibit N) which preserve senior rights of exchanges upstream <br />from the Course. <br />The effect of the Course on the already limited exchange opportunities will be <br />minimal because: <br />f <br />• The Course will have zero consumptive use. <br />• The Course will operate only during the May through September <br />boating season and only from 7 a.m. to 8 p.m., thereby allowing <br />for exchanges during the remainder of the year and day. <br />As shown in Exhibit C, the Course is located in the headwaters of <br />the Colorado River and the limited upstream watershed area <br />(approximately 350 square miles) represents only 3.6 percent of <br />the total Colorado River Basin area (approximately 9,800 square <br />miles). This relatively limited area further reduces the potential <br />for future upstream exchanges. <br />The requested RICD will help increase the frequency and duration <br />of flows exceeding this decreed minimum in-stream right water <br />during the May through September period. The CWCB's in- <br />stream flow right with its 1987 (case No. 5-87CW295) date of <br />appropriation already limits exchanges through this reach of the <br />Blue River. <br />0
